Please read these Terms of Service ("Terms") carefully before accessing or using the WebMaven website (the "Service").

  1. Acceptance of Terms By accessing or using the Service, you agree to be bound by these Terms and any additional terms and conditions referenced herein. If you do not agree to these Terms, you may not access or use the Service.

  2. Service Description WebMaven provides technology consulting, advisement, and coaching services for small businesses and entrepreneurs. Our Service is designed to assist you in leveraging web technologies to grow and optimize your business.

  3. Membership

    3.1 Subscription Plans: The Service offers different subscription plans, including monthly, quarterly, and yearly plans. By subscribing to a plan, you agree to pay the specified fees according to the chosen billing cycle. 3.2 Billing and Payments: You authorize WebMaven to charge your chosen payment method for the applicable fees. 3.3 Subscription Changes: You may upgrade or downgrade your subscription plan at any time through the Service. Changes will be effective immediately and will be reflected in your billing. 3.4 Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing cycle. 3.5 Termination: WebMaven reserves the right to suspend or terminate your access to the Service for violation of these Terms or for any reason deemed necessary.

    3.6 Returns and Refunds: WebMaven reserves the right to deny refunds based on its own self discretion and without notice or liability to Client. Refund requests are assessed on a case by case basis. Should Client request a refund during the first month of use, all materials produced by WebMaven are ownership of the company and are prohibited from being used by the Client in any way. If a refund is deemed to be appropriate, there will be a 25% fee assigned to the remaining billable period.

  4. Intellectual Property The Service and its contents, including but not limited to text, graphics, images, logos, and software, are the intellectual property of WebMaven and protected by copyright and other applicable laws. You may not modify, distribute, reproduce, or create derivative works based on the Service without prior written consent.

    4.1 Ownership: The Service and its contents, including but not limited to text, graphics, images, logos, and software, are the intellectual property of WebMaven and protected by copyright and other applicable laws. 4.2 Client Content: Any content, materials, or information provided by clients through the Service ("Client Content") remains the intellectual property of the respective client. 4.3 License Grant: By submitting Client Content through the Service, clients grant WebMaven a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the Client Content solely for the purpose of providing and improving the Service. 4.4 Ownership of Deliverables: Any deliverables, reports, or materials generated or provided by WebMaven as part of the Service ("Deliverables") shall be owned by the client upon full payment, subject to the license granted to WebMaven to use the Deliverables for promotional and marketing purposes.

  5. User Responsibilities 5.1 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 5.2 Compliance: You agree to comply with all applicable laws and regulations in your use of the Service. 5.3 Prohibited Conduct: You shall not engage in any conduct that may disrupt or interfere with the Service, infringe upon the rights of others, or violate these Terms.

  6. Limitation of Liability To the extent permitted by law, WebMaven and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Service.

  7. Indemnification You agree to indemnify and hold harmless WebMaven, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of or in connection with your use of the Service or violation of these Terms.

  8. Modifications WebMaven reserves the right to modify or update these Terms at any time. The revised Terms will be effective upon posting on the Service. Continued use of the Service after any modifications constitutes acceptance of the revised Terms.

  9. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Connecticut.
